Terms of Service

Agreement to Terms
By downloading, installing, or using Bosco ("the app"), the Bosco event web app at the address shown in the app, or any of our services (together, "Bosco"), you agree to be bound by these Terms of Service. If you do not agree, do not use Bosco.
Bosco is operated by Nuthatch, LLC, Gaithersburg, Maryland ("we", "us"). You must be at least 13 years old to use Bosco, and old enough to enter into a contract where you live to place an order or create an event.
Description of Service
Bosco is a camera app that lets you capture photos with artistic film effects and order physical prints delivered to your door. The app provides a fixed number of exposures per roll, a development process, and print ordering through third-party fulfillment. The product is the physical print. Bosco does not provide digital downloads or digital copies of your photos.
Bosco also lets you host an event: a shared photo event, such as a wedding or party, where guests take photos with Bosco and send them to the event's organizer. Organizers can choose photos and order prints, photo books, and greeting cards from them, and can share those products with the event's guests so that guests can order a copy.
Prices
The price shown in the app or at checkout, before you pay, is the price you pay. Prices are subject to change without notice, but a change never affects an order you have already placed. Our current price list is at bosco-camera.app/prices.
Sales tax is added where required. We ship within the United States only.
Orders and Payments
- All orders are final once submitted for production, except as described under refunds below
- Payments are processed securely by Stripe; we do not store your payment credentials
- Print fulfillment and shipping are handled by Prodigi; delivery times are estimates, not guarantees
- Every photo is reviewed by us before printing. If we cannot print an order as submitted, we will tell you why
- Refund requests may be submitted by contacting us; refunds are issued at our discretion based on the circumstances (for example, damaged or lost shipments), except where these Terms say otherwise
Refunds and Orders We Send Back
- If we reject a personal order, for example because of content that is not allowed, we refund it
- If an event order contains photos we cannot print, we send the order back to the buyer to change. If it is not fixed within 15 days, we cancel it and refund it automatically. The buyer can also cancel it for a refund at any time while it is waiting for changes
- You can cancel an event and get a full refund of the reservation fee, no questions asked, by contacting us at least 48 hours before the event's day begins (midnight at the start of its date, in the event's timezone). Other refund requests for the reservation fee are handled case by case. If we cancel an event because of a problem on our side, we refund the fee
Events
- The host. The person who creates an event is its organizer, and is responsible for the event and for the conduct of the guests they invite. An organizer can add co-organizers, who can see the event's photos and guests, order from them, and change the event's details, including its contact email address and phone number. Only the organizer who created an event can delete it and its photos, and an event never passes to a co-organizer
- Guests. When you join an event, the photos you take for it are sent to the organizer as you take them, and are stored until you or the organizer delete them. The organizer sees them with the name you gave when you joined. Other guests can see your photos only in a product the organizer chooses to share, as watermarked copies with no name attached
- License to the organizer. You keep ownership of your photos. By taking photos for an event, you give the organizer, and us acting for them, a license to store, review, print, and share those photos in products for that event. The license is limited to that event
- Event monitoring. The reservation fee pays for our staff to monitor your event. That means someone from our team can be reached at support@bosco-camera.app if you have a technical issue during your event, and that our staff also watch for illegal photos taken through Bosco and remove them, and the guests who took them, when they find them. We do not review every photo as it is taken
- Limits. Each guest can take up to 240 photos for an event, and photos can be taken only during the event's 24-hour shooting window. We may block a guest or remove photos from an event that break the content policy or these Terms
- Guests under 18. Organizers are responsible for having the permission of a parent or guardian before inviting anyone under 18, and before sharing or ordering their photos
- Contact details. The organizer's name, email address, and phone number are used to run the event, to sign the organizer in to the web app, and for support. See our Privacy Policy
Your Content
- You retain ownership of the photos you capture with the app
- By placing an order, or by taking photos for an event, you grant us a limited license to upload, store, review, and transmit your photos solely to provide Bosco: to print and deliver orders, to keep your archive, and to run events
- You are responsible for ensuring your photos do not violate any laws or third-party rights, and for having the consent of the people in them where the law requires it
- We reserve the right to refuse fulfillment of orders containing prohibited content, and to remove prohibited content
Content Policy
All photos are reviewed before printing. The following content is not allowed and will result in your order being cancelled or your photos being removed:
- Nudity or sexually explicit material
- Violence, gore, or extreme graphic content
- Hate speech, slurs, or discriminatory imagery
- Content involving minors in inappropriate contexts
- Illegal activity
You can report a problem with an event from inside the app. We may report illegal content to the authorities as the law requires, and we may keep it for that purpose.
Photo Storage and Archives
- Photos are stored locally on your device; we are not responsible for local data loss
- Photos you order are kept in long-term cloud storage, at no charge, with no expiration date, so you can reprint them. Archived photos may be restored for reordering, subject to availability
- Photos taken for an event are kept until you or the organizer delete them
- We do not guarantee indefinite storage of any photos, and you should not rely on Bosco as your only copy
Acceptable Use
You agree not to:
- Use Bosco for any unlawful purpose
- Attempt to gain unauthorized access to other users' data or our servers
- Interfere with or disrupt the service or its infrastructure
- Reverse engineer, decompile, or disassemble the app
- Submit content that is illegal, obscene, or infringes on others' rights
- Use an event to collect photos of people who have not agreed to be photographed
Accounts and Data
Your device is identified by an anonymous device token. You do not need an account, a password, or a name to shoot and order prints. If you create an event, you give us your name, email address, and phone number. If you join one, you give us a name to show the organizer. If you order, you give us a shipping name and address. We handle this information as described in our Privacy Policy.
Data Deletion
You may delete the data associated with your device at any time using the "Delete my account & data" option in the app. This removes your photos, archive, order history, and device record from our servers, and removes every event you organize, along with all of that event's photos, even if it has co-organizers: only its organizer can delete an event, and it never passes to a co-organizer. This action cannot be undone. Deletion is not available while you have a paid order still being produced or shipped. A request to delete your data made in the event web app is reviewed by us before it is carried out. Our Privacy Policy lists what deletion does not remove, and how to ask us to delete information you cannot delete in the app.
Intellectual Property
The app, including its design, code, filters, and branding, is owned by us and protected by intellectual property laws. Your photos remain yours.
Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. PRINT QUALITY, COLOR ACCURACY, AND DELIVERY TIMES MAY VARY.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF PHOTOS, FAILED DELIVERIES, OR PRINT QUALITY ISSUES.
Termination
We reserve the right to suspend or terminate your access to Bosco at any time, with or without cause. You may stop using Bosco and delete your data at any time.
Changes to the Service
We may change, suspend, disable, or retire Bosco, or any part of it, including the app, the event web app, events, products, and features, at any time, for any reason, and without notice.
Changes to Terms
We may modify these Terms at any time. When a change is material, we will ask you to accept the new Terms in the app. Continued use of Bosco after changes constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict of law provisions.
